This Privacy Policy applies to all permitted users of the Ecosystem and acknowledges the Personal Data Protection Act 2012 (“PDPA”) of Singapore and Panama Law 81 of 12 March 2019 (Personal Data Protection) as comparable data-protection benchmarks. Singapore is a Restricted Jurisdiction and access to the Service from Singapore is prohibited; see the Terms and Conditions for the full list of Restricted Jurisdictions. Where applicable, references in this Privacy Policy to the PDPA include analogous protections under Panama Law 81 of 2019.

“OpenForage Ecosystem” shall mean the collective reference to all tools, platforms, websites, and functionalities provided by OpenForage Company, S.A., and other features designed for user engagement with the “RISKUSDC”, “atRISKUSDC”, or “FORAGE” Tokens.
“OpenForage Site” means the website at https://openforage.ai, associated systems, and subdomains thereof, including the mobile-optimised versions of such website.
“Token” refers to the “RISKUSDC”, “atRISKUSDC”, or “FORAGE” Tokens, virtual tokens built on the Ethereum blockchain as ERC-20 tokens, designed to serve as utility tokens within the OpenForage Ecosystem.
“Liquidity Pool” means the pool created within the OpenForage Ecosystem on platforms like Uniswap, where users may provide liquidity by contributing the Tokens and $ETH in equal proportions to support market stability.
“Service” or “Services” shall have the meaning ascribed to it under the Terms and Conditions specific to the OpenForage Ecosystem. For the avoidance of doubt, non-capitalised reference to “service” or “services” shall have the ordinary meaning of service in this Privacy Policy.
“Terms” refers to the terms and conditions of use of the OpenForage Ecosystem and its associated services.
“Personal data” and other terms defined under the Personal Data Protection Act 2012 (“PDPA”) shall have the meanings ascribed to them under the PDPA where used in this Privacy Policy.
Where you are an EU Data Subject, as defined under the General Data Protection Regulation (“GDPR”), Section 17 shall also apply to you.
The headings used in this Privacy Policy are for convenience only and shall not affect the interpretation of these provisions.
This Privacy Policy applies to users when browsing, visiting, accessing and/or using any part of the Ecosystem, including sale and purchase of the Token.
This Privacy Policy sets out our commitments and explains the rights that you have with respect to your personal data. If you do not agree to the terms of this Privacy Policy, please do not use the Services or any part thereof.
You shall not be permitted to use the Services where you do not confirm your acceptance of this Privacy Policy.
By browsing, visiting, accessing, and/or using the Ecosystem (including any interaction with the Token) and/or when you provide personal data to us, you consent to the collection, storage, use, disclosure, and processing of your personal data by the Company in accordance with this Privacy Policy.
This consent shall remain effective unless you notify us in writing of its withdrawal and provide the reason for such withdrawal.
If you do not consent to this Privacy Policy, you shall not use our Services, and if you withdraw your consent, you must immediately cease using the Services.
The processing of your personal data is necessary for:
The performance of our contractual obligations towards you under the Terms, including granting you access to the OpenForage Ecosystem and providing you with related Services;
Protecting our legitimate interests in ensuring the security, functionality, and proper operation of the Ecosystem; and

Failure to provide the relevant personal data or limiting our ability to process your personal data may affect our ability to grant you access to the Ecosystem, provide the Services, and/or your ability to fully enjoy the benefits of the Ecosystem.
The OpenForage Ecosystem and/or the Services may require the registration and provision of your information, including personal data.
Upon Creating a Profile or Registering with Us- When you create an account with us, register a profile, or access features within the Ecosystem, you may be required to provide personal data. This information forms part of your unique digital identity within the Ecosystem.
For Compliance with Anti-Money Laundering and Counter Financing of Terrorism (“AML/CFT”) Measures- OpenForage Company, S.A. complies with applicable AML/CFT laws and implements an AML/CFT Policy, which may be updated and published by the Company from time to time. To meet these compliance requirements, we may request personal data, including but not limited to identification documents, photographs, and other necessary details.
Whenever You Submit Information via the Ecosystem or Services- In the course of interacting with other users or using the Services accessible via the OpenForage Ecosystem, you may disclose personal data voluntarily. This includes interactions through tools or other features of the Ecosystem.
If you access the Services using a blockchain wallet (for example, MetaMask or other supported wallets), we may collect and process your public wallet address and information relating to transactions associated with that wallet address when interacting with the protocol. Wallet addresses are publicly visible on the blockchain and are not created or controlled by us.
Voluntary Disclosure of Information- Providing personal data is voluntary; however, failure to provide required information may limit your ability to create a profile, register within the OpenForage Ecosystem, or fully utilise the Services.
To enable us to provide the OpenForage Ecosystem and/or Services effectively, the information you provide must be accurate, complete, and free from material omissions. You are responsible for keeping this information up to date. If your information is inaccurate, incomplete, or outdated, please notify us promptly with accurate and updated details.
If you provide personal data about another individual, you confirm that you have obtained their consent to act on their behalf, to allow the processing of their data in accordance with this Privacy Policy, and to receive any data protection notices on their behalf.
We collect the following personal data about you:
Profile and Registration Information- When you create an account or register with the Ecosystem, you may be required to provide personal details such as your name, email address, country of residency, and other necessary information to facilitate your use of the Ecosystem and related Services.
Third-Party Account Information- If you choose to link third-party accounts, such as social media accounts (e.g., Telegram or X), to your OpenForage profile, we may collect and analyze information from those accounts. For clarity, while the Company has access to this information, it does not control or manage your third-party accounts.
Blockchain Data- We may collect and analyze public blockchain data related to the Tokens, including transaction IDs, wallet addresses, timestamps, transaction amounts, interactions with smart contracts, and user activity within the Ecosystem. Blockchain data is stored on decentralised ledgers and, while accessible by the Company, is not controlled or managed by the Company.
Wallet Information- You may link your Ethereum-based ERC-20 wallet to your OpenForage profile to facilitate interactions with the Token and other Ecosystem functionalities. We may access wallet-related data, including wallet address and transaction details, to support your activities within the Ecosystem. However, the wallet remains under your control and is not managed by the Company.
Voluntary Information- When you communicate with us—for example, through customer support inquiries, feedback forms, or email—we collect the personal data you provide to respond effectively to your inquiries or feedback.
Technical Information- Technical details such as your IP address, device model, browser type, operating system, and approximate location may be automatically recorded when you access the Ecosystem or Services.
Other Personal Data- In the course of using the Ecosystem, you may disclose personal data about yourself or others through content uploaded to the Ecosystem, such as posts, proposals, or feedback. This information may be stored on our servers.
Additional Information We Collect:
Ecosystem Usage Data- We collect data about how you interact with the Ecosystem. This includes, but is not limited to, the type of device you use, your operating system language, your browser type, your geolocation, and details about your activities within the Ecosystem.
Platform Interference Data- To ensure optimal performance of the Ecosystem, we may access data about applications installed on your device if such applications interfere with the Ecosystem’s functionality (e.g., blocking notifications). In such cases, you may be notified to take corrective action.
A cookie is a small piece of text sent to your browser or device when you access the OpenForage Ecosystem or its associated Services. Cookies are used to enhance and personalise your experience on the Platform.
Persistent Cookies: These cookies may be used to save your settings and customisations on the OpenForage Ecosystem. For instance, if you log in to the Platform, a persistent cookie will help recognise you as an authorised user, so you do not need to log in every time you access the Platform.
Session Cookies: These cookies are temporary and help improve the functionality of the Services during your session but are deleted when you close your browser or application.
Cookie Management and Consent- Strictly necessary cookies (those required for the Service to function, including session-management and security cookies) are set without your prior consent on the legal basis of legitimate interest. Service Providers- We may share your personal data, as reasonably necessary, with contractors or consultants, including vendors and suppliers that provide services related to the operation, development, and maintenance of the Ecosystem. These service providers may also assist with analytics and other operational support. The Company requires all service providers to adhere to obligations of confidentiality and limits the use of your personal data to the extent necessary to provide their services.
Sanctions Screening Providers- We may share your wallet address, IP address, and related on-chain data with recognised sanctions-screening providers (such as Chainalysis, TRM Labs, or equivalent) to comply with applicable sanctions laws administered by the United States Office of Foreign Assets Control (OFAC), the United Nations, the European Union, the United Kingdom, and other relevant authorities.
Law Enforcement and Legal Authorities- We may share your personal data with law enforcement authorities, courts, tribunals, or legal advisors when required to respond to legal requests, comply with a legal obligation, or protect and defend the rights or property of the Company or its users.
Merger, Acquisition, or Sale- In the event of a merger, acquisition, or sale of all or part of our assets, your personal data may be transferred to the acquiring organisation.
Auditors and Professional Advisors- Your personal data may be shared with our auditors for business auditing purposes or with legal and professional advisors to enforce our rights, defend claims, or support our operations.
Data Intermediaries- We may appoint third-party organisations to process or store your personal data on our behalf in connection with the Ecosystem. These data intermediaries are required to process your personal data in accordance with this Privacy Policy and applicable laws.

We make every effort to ensure that aggregated data does not include any personally identifiable information. The blockchain technologies powering the Platform and/or enabling the delivery of the Services may analyse and/or combine all information we receive (as set out under this Privacy Policy), with information from other users to create aggregated data that may be disclosed to and utilised by us, our affiliates and by third parties without restriction, on commercial terms that we can determine in our sole discretion, for purposes including but not limited to;
content marketing;
research purposes;
in order to understand behaviour patterns;
marketing strategies and for entering into commercial contracts in order to provide our users with the Services (including the Third Party Services); and
to periodically enhance the Platform and/or the Services.
You may request access to and correction of, your personal data and limit the processing of your personal data or make any enquiries or complaints in respect of the processing of your personal data, by contacting us at the contact details set out in “How to Contact Us” section below. You are responsible for informing us when your personal data or preferences have changed and require updating. We shall, within a reasonable time frame, attend to your request for access to and correction of your personal data or updating of your preferences.
You may at any time, in your sole discretion or at the direction of our data protection team, delete content containing personal data which you have shared in the Ecosystem.
As the Token operates on a decentralised blockchain, certain data stored on the blockchain, such as transaction details and wallet addresses, cannot be modified or deleted due to the immutable nature of blockchain technology. While we can assist with updates to data stored within our systems, further blockchain-related data is beyond our control.
Off-chain storage: We store information and data on public and/or private cloud, where your data can be stored and/or backed up in any of the jurisdictions where the cloud service providers provide their cloud service. You hereby consent that we may store your personal data on our cloud server, which may be located outside the Republic of Panama (where the Company is incorporated) or the jurisdiction in which the Services were obtained or used.
The Company utilises a network of storage and server resources designed to meet the security and accessibility requirements of the Ecosystem. We engage only service providers that demonstrate the capability to manage the technology, volume, and sensitivity of the data provided by users of the Ecosystem and its Services.
The Company will not transfer your personal data to a country or territory outside the Republic of Panama or Singapore that does not provide protection of personal data that is comparable to the protection under Panama Law 81 of 2019 or the PDPA.
We do not collect or store personal data beyond what is necessary to operate the Services. The Company applies the following retention periods unless a longer period is required by applicable law or regulatory direction: (a) wallet addresses, transaction history, and on-chain data captured for AML/CFT, sanctions-screening, audit, dispute-resolution, or protocol-governance purposes — retained for seven (7) years from the date of the relevant interaction, consistent with prevailing AML record-keeping obligations; (b) IP address logs and access logs collected for security and anti-fraud purposes — retained for twelve (12) months; (c) profile and registration information voluntarily provided — retained for two (2) years from the date of the User’s last interaction with the Service; and (d) anonymised analytics or system logs — retained for a maximum of twelve (12) months and anonymised or deleted thereafter.
Any information voluntarily provided by users (e.g., via support inquiries) will be retained only for as long as necessary to address the inquiry and for a maximum period of two (2) years thereafter for legal, regulatory, or operational purposes.
If you do not interact with the Services for a consecutive period of one (1) year, any voluntarily provided personal data may be deleted, except where retention is necessary to meet legal, regulatory, or operational obligations.
Data stored on the Ethereum blockchain or other distributed ledger technologies supporting the protocol (“On-Chain Storage”) is not controlled or held by the Company. Such data is publicly accessible but remains outside the Company’s control or possession due to the decentralized nature of blockchain technology.
As the owner of Tokens and any associated wallets, you are solely responsible for controlling your activity on the blockchain, including the retention or deletion of such data. The Company has no ability, nor obligation, to retain or delete data stored in On-Chain Storage. To the extent that analytics or system logs are collected to monitor Platform performance or security, such data will be retained for a maximum of twelve (12) months and will be anonymized or deleted thereafter.
Our Services may link to or refer to websites or mobile device services that we do not control. Any personal data you provide on the linked pages is provided directly to this third party and is subject to this third party’s provider’s privacy policy. This Privacy Policy does not apply to such other websites or mobile device services, and we are not responsible for the privacy practices or content of any website or mobile device service not controlled by us.

We have implemented administrative, technical, and physical safeguards to prevent unauthorised access, use, or disclosure of your personal data. Your information is stored on secure servers and is not publicly accessible. Access to your personal data is limited to employees or partners who require it to fulfill the purposes outlined in this Privacy Policy.
You play an essential role in safeguarding your account. Protect your password and limit unauthorised access by signing off after completing your session. You are solely responsible for maintaining the confidentiality of your password and account credentials and for all activities conducted under your account, including unauthorised use.
While we strive to protect your personal data, we cannot guarantee absolute security. Transmission of data over the internet involves inherent risks, and you acknowledge that any data you transmit using the Ecosystem is at your own risk.
Data stored on the blockchain supporting the Ecosystem is decentralised and immutable. The Company does not control or own this data, which is stored on a distributed ledger. On-chain data may include information necessary for identity verification and data integrity.
We utilise off-chain storage for personal data you provide directly to the Company. Off-chain data is encrypted at rest and in transit and stored in secure, scalable, and highly available cloud services.
Data Breach Management- In the event of a data breach, we will:
Assess the extent of the breach and take immediate measures to contain it, minimising harm to affected users;
Investigate the cause of the breach and implement measures to prevent recurrence;
Determine whether the breach qualifies as a notifiable data breach under applicable data protection laws;
Notify relevant authorities, such as the Singapore Personal Data Protection Commission or the Panamanian Autoridad Nacional de Transparencia y Acceso a la Información, if required;
Inform affected users of the breach, where necessary, in compliance with applicable regulations;
Take continuing action to mitigate harm, including reviewing and improving security measures.
We will manage data breaches in accordance with the Guide on Managing and Notifying Data Breaches under the PDPA and the equivalent guidance issued under Panama Law 81 of 2019. By continuing to use the Ecosystem following a breach, you acknowledge and accept the adequacy of measures taken by the Company to address the breach.
Indemnity- You agree to indemnify the Company for any loss or damage arising from your breach of the Terms, including if you post personal data on the OpenForage Ecosystem in violation of these Terms.
Acknowledgment of Risks- Despite our robust security measures, you acknowledge that malicious actors, evolving hacking technologies, and other threats may compromise your personal data.
Limitation of Liability- To the fullest extent permitted by law, you waive any claims against the Company for any loss, liability, damage, or cost incurred due to data breaches, except where such breaches result from the Company’s negligence, fraud, or willful misconduct.
The Ecosystem and its Services are intended for use by individuals who are 18 years of age or older. If you are under 18 years of age, you must obtain the consent of your legal guardian to use the Services.
We do not knowingly collect personal data from individuals under 18 years of age without the consent of their legal guardian. If you become aware that a child under 18 years of age has been using the Services without proper consent, or if someone has been using the Services on behalf of a child without proper consent, please contact us using the details provided under the “How to Contact Us” section. Upon notification, we will take reasonable steps to delete the child’s personal data from our active databases.
We reserve the right to periodically review our user base and take appropriate action if we have reasonable grounds to believe that an individual using the Services is under 18 years of age and lacks the necessary consent. Such actions may include, but are not limited to, restricting access to or deleting the user’s account.
The Ecosystem and its Services are intended for use by corporations or legal entities that are duly incorporated, validly existing, and in good standing in the jurisdiction in which they are established. We have no control over the personal data protection policies or practices adopted by these organisations or entities.
By agreeing to this Privacy Policy, you acknowledge and accept that any personal data you provide to such corporations or legal entities while using the Ecosystem is shared at your own discretion and risk. The Company assumes no control over, and accepts no liability for, the handling of your personal data by these organisations or entities.
We acknowledge that the General Data Protection Regulation (GDPR) will apply if we process or hold personal data of individuals residing in the European Union (EU) or if we offer goods or services to individuals in the EU (“EU Individuals”). The European Union is a Restricted Jurisdiction; this section applies in the limited residual cases where EU data nonetheless reaches the Company (for example, if a user successfully circumvents the geographic restriction).
Lawful Basis for Processing- We may lawfully process personal data under the GDPR if:
Consent is provided by the EU Individual for specific purposes;
It is necessary for the performance of a contract; or
It is necessary for compliance with a legal obligation.
Principles of Data Processing- Personal data will be processed in accordance with the GDPR, ensuring it is:
Processed lawfully, fairly, and transparently;
Collected and used only for specified, explicit, and legitimate purposes;
Limited to what is necessary for the purposes for which it is processed;

Sensitive Personal Data- Sensitive personal data (special categories of personal data) as defined under the GDPR, including data related to race, ethnicity, religious or philosophical beliefs, sexual orientation, political opinions, trade union membership, health, genetic or biometric data, may be processed only for the purposes and uses outlined in this Privacy Policy.
Rights of EU Individuals- EU Individuals are afforded the following rights under the GDPR:

Acknowledgment of GDPR Compliance- By continuing to use the OpenForage Ecosystem, you agree that this Privacy Policy and the Terms and Conditions of the OpenForage Ecosystem provide sufficient protection for your personal data rights under the GDPR. We reserve the right to update or modify this Privacy Policy at any time and from time to time. By continuing to use the Services after any such changes, you agree to follow and be bound by this Privacy Policy as changed.
